Terms of Service
Last updated: 25 September 2026
These terms govern your use of Qartlo (the “Service”), operated by Qartlo. By creating a store you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
1. What the Service is — and is not
Qartlo is software that lets a merchant run an online store: list products, publish a storefront at a Qartlo address or your own domain, take orders, and manage fulfilment.
We are not the seller. The contract for any purchase is between the merchant and their customer. We do not stock, ship, inspect, or guarantee any product sold through a store built on the Service.
We never hold your money. Card and UPI payments are processed through the merchant’s own Razorpay account, using API keys the merchant supplies and controls; funds settle directly to the merchant under Razorpay’s terms, and never pass through Qartlo. Cash-on-delivery orders are collected by the merchant directly. The only money that flows to us is your own subscription fee (section 6).
2. Eligibility and your account
- You must be able to enter a binding contract under Indian law.
- You are responsible for all activity under your account and for keeping credentials safe.
- You must give accurate business details and keep them current.
- One store per account. The Service identifies a store by its owner, and creating a second store on one login is not supported.
- Your store’s web address is yours for as long as your account exists, including while the store is paused. We do not release it to someone else in the meantime.
3. The controls you hold over your storefront
You decide when your store is open. From your admin settings you can take the storefront offline entirely, pause incoming orders while staying visible, set opening and closing hours, mark weekly holidays, and switch on vacation mode.
These are your decisions and their consequences are yours. When you take a store offline, customers who visit it see a holding page with your name and contact details rather than your catalogue — they can still reach you, but they cannot browse or buy. We are not responsible for sales lost while a store is paused, whether you paused it or it was paused for non-payment under section 7.
4. Acceptable use
You may not use the Service to:
- sell anything unlawful, or anything prohibited by your payment gateway;
- infringe someone else’s intellectual property (see section 5);
- send unsolicited bulk messages to customers;
- collect customer data through your storefront for a purpose you have not disclosed to them;
- probe, scrape, overload, or attempt to bypass the Service’s access controls, rate limits, plan restrictions, or order counting;
- resell or white-label the Service without a written agreement.
You acknowledge that unauthorised use of the Service may lead to action against you under these terms and under applicable Indian law, including but not limited to the Information Technology Act, 2000.
5. Intellectual property — strict policy
5.1 Absolute prohibition on infringing content
You are strictly prohibited from listing, selling, advertising, or promoting any product or service on Qartlo that infringes the intellectual property rights of any third party. This includes but is not limited to:
- Counterfeit or fake products — items bearing unauthorised trademarks or brand names.
- Pirated software, apps, or digital goods — unauthorised copies or accounts for software such as VPNs, streaming services, antivirus tools, or any paid software.
- Cracked accounts or subscription sharing — selling access to any subscription service without authorisation from the service provider.
- Copyrighted media — unauthorised copies of movies, music, e-books, courses, or digital content owned by others.
- Trademarked brand names used without authorisation — using the brand names or logos of companies you have no affiliation with to sell products.
- Replica luxury goods — items marketed as copies, replicas, or “inspired by” luxury brands.
5.2 Consequences of violation
Any violation of this policy will result in immediate and permanent action without prior notice:
- Immediate store deactivation — we set your store’s status to suspended, which takes your storefront offline for customers the moment it is applied.
- Permanent account suspension — your account will be permanently suspended with no possibility of reinstatement.
- No refund — subscription fees already paid will not be refunded, and any part-used billing period is forfeited. This is consistent with our Refunds & Cancellations policy.
- Reporting to rights holders and authorities — we will cooperate with rights holders, law enforcement, and legal authorities, including disclosing your account information (name, email, phone number, and IP address) where we are required or lawfully permitted to do so.
- Search de-indexing — infringing URLs may be reported to Google and other search engines for removal from their indexes.
Infringement is an urgent legal reason, so the notice period in section 11 does not apply to it. We act immediately.
5.3 Reporting infringement
Qartlo responds to copyright complaints under the Digital Millennium Copyright Act (DMCA) and the equivalent Indian provisions of the Copyright Act, 1957 and the Information Technology Act, 2000. If you believe content on the Service infringes your copyright or trademark, write to:
Copyright complaints — Qartlo
yeswanth.qartlo@gmail.com
Subject line: COPYRIGHT INFRINGEMENT NOTICE — [your brand name]
So we can act on it, a notice should include:
- identification of the work or mark you own, and proof of your rights in it;
- the exact URL or URLs of the infringing listing on the Service;
- your name, address, telephone number, and email address;
- a statement that you believe in good faith the use is not authorised by you, your agent, or the law;
- a statement that the information in the notice is accurate and that you are the rights holder or authorised to act on their behalf.
On receiving a valid complaint we will remove the infringing content within 24 hours, suspend the store owner’s account, and cooperate with legal proceedings as required.
5.4 Our role as an intermediary
Qartlo is an intermediary as defined under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Listings are published by merchants directly and are not reviewed or approved by us before they go live. We do not endorse, verify, or take responsibility for the products or content listed by individual store owners. Each store owner is solely and fully liable for the content they publish and the products they sell. Qartlo acts only as a technology provider and is not liable for infringement committed by a store owner.
By creating a store on Qartlo, you confirm that you own or have full legal authorisation to sell every product you list. Any misrepresentation is a violation of these terms and of applicable law, and will result in permanent account termination and possible legal action.
6. Free orders, plans, and fees
Free orders. A new store may accept up to 10 orders at no charge. Every order counts once, whether it is paid online or cash on delivery, and the counter does not reset. You can see how many remain on your billing page. Once the allowance is used up, an active subscription is required to keep accepting orders.
Plans. Subscriptions are sold as Starter and Pro. Both include the storefront, catalogue, orders, and customer records. Pro additionally includes:
| Feature | Starter | Pro |
|---|---|---|
| Storefront, catalogue, orders, customers | Yes | Yes |
| Your own custom domain | No | Yes |
| Downloadable reports (orders, products, customers) | No | Yes |
| Abandoned checkout tracking | No | Yes |
| Outbound order-status webhooks | No | Yes |
We may change what each plan includes. If a change removes a feature you are actively using, we will give notice by email before it takes effect.
Billing. Current prices are shown on your billing page before you subscribe.
- Prices are in Indian Rupees and are inclusive of GST at the applicable rate. A GST tax invoice is issued for every payment and is available on your billing page. It shows CGST and SGST where you are in the same state as us, or IGST where you are not. Add your GSTIN in store settings before you subscribe if you need it to appear on your invoices.
- Subscriptions are charged through Razorpay Subscriptions and renew automatically for the interval you chose — monthly or yearly — until cancelled.
- Cancelling stops the next renewal. Your plan stays active until the end of the period you have already paid for; we do not pro-rate or refund the unused part of a period.
- We may change prices with at least 30 days’ notice by email. A change takes effect at your next renewal, and you may cancel before then.
Refunds are covered in our Refunds & Cancellations policy.
7. What happens if payment lapses
This section describes exactly what the Service does, so there are no surprises. Your account enters a lapsed state when your free orders run out, when a renewal fails, when your subscription expires or is halted by the payment provider, or when we suspend it under section 11.
While your account is lapsed:
- Your storefront goes offline. Customers who visit it see a holding page carrying your store name, logo, and contact details instead of your catalogue. Your products are not shown and no new orders can be placed, online or cash on delivery.
- Orders you already have are not touched. You keep access to your existing orders and can continue to update, fulfil, and complete them. We will not lock you out of customers you have already taken money from.
- Your billing page stays open so you can see what is owed and pay it.
- Other admin areas are restricted. Changes to your catalogue, store settings, and imports are refused until the account is brought back into good standing.
- Nothing is deleted. A lapse suspends the Service; it does not erase your data. Deletion only follows termination, under section 11.
Everything is restored as soon as a subscription is active again. If an online payment is captured for an order at the moment your account lapses, we honour that order rather than stranding your customer’s money, and record it against your account.
8. Your content and data
You retain full ownership of everything you create and upload to Qartlo, including product images, descriptions, customer records, order history, and store customisations. You grant us a limited licence to use that content solely to provide the Service to you — to host it, display it on your storefront, back it up, and operate the features you have enabled. We claim no other rights in it. We do not sell it, and we do not use your catalogue or customer lists to market to your customers.
You are the controller of your customers’ personal data; we are your processor. Names, phone numbers, delivery addresses, and order histories collected through your storefront are collected for you. You are responsible for having a lawful basis to collect them, for telling your customers what you do with them, and for answering their requests. This applies equally to details captured at checkout before an order is completed. The Service records what a customer has typed into your checkout form as they fill it in, on every plan, so that an abandoned basket can be recovered; the tools for reviewing and following up on those records are a Pro feature. Either way, those are real people who did not buy anything, and whether you contact them is your decision and your responsibility.
We process personal data as described in our Privacy Policy, in accordance with applicable Indian data protection law.
Getting your data out. While your account is in good standing you can export your customer list from your admin panel at any time, and, on a Pro plan, download reports of your orders, products, and customers. If your account is lapsed, suspended, or closed and you cannot reach those screens, email support@qartlo.com from the address on your account and we will provide an export. We keep your account data for 30 days after closure for this purpose, after which it is deleted. Keep your own copies; do not rely on us as your only backup.
9. Third-party services and links
The Service depends on third parties, and some parts of it only work because you have your own account with one of them:
- Razorpay — both for your customers’ payments, through your own merchant account and keys, and for your subscription to us. Razorpay’s terms govern those payments, including settlement timing, chargebacks, and any hold on your funds. We cannot release, reverse, or expedite a settlement.
- Your domain registrar and DNS provider, if you connect a custom domain. Pointing DNS correctly, and renewing the domain, are yours to manage.
- Our hosting and infrastructure providers, whose outages affect the Service.
The Service may also contain links to third-party websites. Following one puts you under that site’s terms and privacy policy. Links are provided for convenience and do not signify that we endorse the site; we are not responsible for its content.
10. Availability, warranties, and disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Neither we nor any third party warrants the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered through the Service for any particular purpose. Such information may contain inaccuracies or errors, and we exclude liability for them to the fullest extent permitted by law.
We aim to keep the Service available continuously, but we do not promise uninterrupted or error-free operation. We may take the Service down for maintenance, updates, or modifications. Unless a separate written agreement says otherwise, the Service carries no contractual uptime guarantee.
11. Suspension and termination
By you. You may cancel your subscription at any time from your billing page; it stops the next renewal and your plan runs to the end of the paid period. To close your account entirely, write to support@qartlo.com from the address on your account. You then have 30 days to obtain an export of your data before it is permanently deleted.
By us. We may suspend or terminate an account and access to the Service for non-payment, for a breach of these terms, for illegal activity, or where required by law or by our payment gateway.
- We will give reasonable notice before suspending for anything other than an urgent safety, security, or legal reason.
- Infringement under section 5, illegal activity, and threats to the security or integrity of the Service are urgent legal reasons: we act immediately and without prior notice.
- Non-payment is not an urgent reason. It puts your account into the lapsed state described in section 7, which is reversible at any time by paying, and does not by itself delete anything.
- After termination you have 30 days to obtain an export. After that we may delete your data.
12. Limitation of liability
To the fullest extent permitted by law, Qartlo, its affiliates, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- your access to, use of, or inability to use the Service;
- the conduct or content of any third party on the Service, including any merchant and any customer;
- any content obtained from the Service;
- unauthorised access to, use of, or alteration of your transmissions or content;
- the acts, delays, or failures of your payment gateway, domain registrar, or any other provider you have chosen.
Our total liability arising out of the Service in any 12-month period is limited to the fees you paid us in that period. Where you have paid us nothing — for example while using the free orders in section 6 — our liability is limited to the resupply of the Service.
Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
13. Indemnification
You shall indemnify and hold harmless Qartlo, its affiliates and group companies and their respective officers, directors, agents, and employees from any claim, demand, or action — including reasonable legal fees, and any penalty imposed — arising out of:
- your breach of these terms or of the Privacy Policy;
- your violation of any law, rule, or regulation;
- your violation of the rights of a third party;
- your use or misuse of the Service;
- any dispute between you and a customer of your store, including over a product, a delivery, a refund, or a chargeback.
14. Changes to these terms
We may update these terms at any time. It is your responsibility to review them periodically. For material changes we will make reasonable efforts to give notice by email or in the app before they take effect. Continuing to use the Service after a change means you accept the updated terms.
15. Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of India. The courts at Andhra Pradesh, India have exclusive jurisdiction over any dispute arising out of or in connection with them.
You understand that on subscribing to the Service you enter into a legally binding and enforceable contract with Qartlo.
16. Severability
If any provision of these terms is found invalid or unenforceable by a court of competent jurisdiction, that provision is severed and the remainder stays in full force and effect.
17. Entire agreement
These terms, together with the Privacy Policy and the Refunds & Cancellations policy, are the entire agreement between you and Qartlo regarding the Service, and supersede any prior agreement relating to your use of it.
